Lusty Looters is a privately managed community ARK cluster. Access to the servers, Discord, website, store, vote systems, rewards, events, support channels, and related services is provided at the discretion of server management.

1.2 Not Affiliated Disclaimer

Lusty Looters is not affiliated with, endorsed by, sponsored by, or officially connected to Studio Wildcard, Snail Games, CurseForge, Discord, Steam, Xbox, PlayStation, or any other third party platform or service.

All game names, logos, assets, trademarks, and related materials remain the property of their respective owners.

1.3 Access and Availability

Access may be restricted, suspended, or removed where required for moderation, security, abuse prevention, technical maintenance, rule enforcement, chargeback review, fraud prevention, server health, or community safety.

2.1 Information Processed

Lusty Looters may collect or process limited information needed to operate the cluster, website, Discord services, voting rewards, account linking, store delivery, fraud prevention, moderation, support tickets, and server security.

This may include Discord account details, platform identifiers, character names, tribe names, server logs, vote records, store records, delivery records, IP related technical data, support messages, screenshots, clips, and other information submitted by players.

2.2 Purpose of Processing

• Operating the ARK cluster, website, vote systems, account linking, rewards, store delivery, and support systems.
• Investigating moderation issues, support issues, fraud, abuse, chargebacks, technical errors, failed delivery, and rule violations.
• Protecting the cluster, economy, community, backend services, webstore systems, and server performance.

2.3 Data Requests

Players may contact official support to request review, correction, or deletion of personal information where applicable. Some records may be retained where needed for security, fraud prevention, chargeback handling, legal compliance, dispute review, moderation history, or server operation.

3.1 Age Notice

Lusty Looters services are not intended for children under 13. Players under 13 should not use the website, Discord, store, vote systems, account linking, or related services without appropriate parental or guardian involvement.

3.2 Parent or Guardian Requests

If staff become aware that personal information has been collected from a child under 13 where parental consent is required, reasonable steps may be taken to remove or restrict that information.

4.1 California Rights

California residents may have privacy rights under applicable California privacy laws, including rights to request information about personal data collected, request deletion where applicable, request correction where applicable, and opt out of certain data sharing where applicable.

4.2 No Sale of Personal Information

Nothing in these rules, terms, webstore conditions, refund terms, disclaimers, or service notices is intended to exclude, restrict, or modify any rights that cannot lawfully be excluded under the Australian Consumer Law.

Where the Australian Consumer Law applies, players may have rights known as consumer guarantees. These rights may apply to eligible products or services supplied to Australian consumers, including online transactions.

6.2 Refunds and Consumer Guarantees

Lusty Looters may refuse refunds, replacements, or compensation where a digital item, reward, creature, currency, perk, or service has been correctly delivered and later lost, used, consumed, transferred, removed for rule violations, affected by normal gameplay, or impacted by player error.

However, this does not limit any non-excludable rights a player may have under applicable consumer protection law, including the Australian Consumer Law where it applies.

If a delivery failure, duplicate charge, incorrect item delivery, or verified server-side error occurs, players should contact official support so the issue can be reviewed.

6.3 Digital Server Items

Webstore items, vote rewards, server currency, supporter perks, creatures, saddles, blueprints, kits, and other digital benefits are provided for use only within the Lusty Looters cluster.

They do not represent real-world currency, cash deposits, investment products, stored-value accounts, or ownership rights outside the Lusty Looters servers.

6.4 Misleading Claims

Lusty Looters aims to describe webstore items, rewards, perks, server features, and services accurately. Prices, features, rewards, rates, maps, commands, delivery systems, and store listings may be corrected, updated, replaced, or removed where needed.

Nothing on the website, Discord, store, vote pages, or server should be interpreted as a guarantee that any server, item, perk, reward, rate, command, or feature will remain available permanently.

6.5 Australian Privacy Notice

Where Australian privacy laws apply, Lusty Looters will handle personal information in line with applicable privacy obligations.

Information that may be processed includes Discord identifiers, account linking data, platform IDs, character names, tribe names, vote records, store records, delivery logs, server logs, moderation records, support tickets, screenshots, clips, and technical data needed to operate, secure, and moderate the cluster.

Payments may be handled through third party payment providers. Lusty Looters does not require players to provide payment card details directly to server staff through Discord or in game.

Store records may be used to verify purchases, deliver digital rewards, investigate failed delivery, prevent fraud, resolve support issues, and enforce webstore rules.

7.2 Refund Terms

Refunds are not guaranteed and may be refused where items have been delivered, consumed, used, transferred, lost through gameplay, or removed due to rule violations, except where applicable law requires otherwise.

7.3 Chargebacks and Payment Abuse

Chargebacks, fraudulent payments, payment abuse, false claims, or misuse of store systems may result in account restrictions, removal of delivered items, store bans, Discord action, or server bans.

7.4 Digital Item Limits

Purchased items, creatures, currency, perks, or services may be changed, limited, removed, replaced, or denied if required for balance, abuse prevention, technical issues, rule enforcement, or server health, except where applicable law requires otherwise.

8.1 Logs and Moderation Data

Lusty Looters may use server logs, admin logs, Discord logs, website records, vote records, store records, delivery records, screenshots, clips, player reports, and backend tracking tools to investigate support issues, fraud, abuse, technical problems, or rule violations.

Moderation and enforcement decisions may be based on available logs and staff review.

8.2 Third Party Services

Lusty Looters may rely on third party services such as Discord, hosting providers, payment processors, ARK server tools, vote websites, mods, APIs, and platform services.

Lusty Looters is not responsible for outages, errors, bans, restrictions, delays, or data issues caused by third party services.

9.1 No Warranty

Lusty Looters services are provided as is and as available. No guarantee is made that the servers, website, Discord, store, vote systems, reward systems, player linking, or backend services will always be online, secure, uninterrupted, error free, or free from data loss.

9.2 Gameplay Loss Disclaimer

Lusty Looters is not liable for the loss of characters, tames, structures, items, currency, progress, rewards, purchases, blueprints, saddles, tribe ownership, or access caused by gameplay, ARK bugs, crashes, rollbacks, mods, decay, tribe settings, server restarts, connection issues, player error, exploits, or third party service issues, except where applicable law requires otherwise.

Replacements may only be considered when server management can verify a server side issue, failed delivery, or administrative error.

9.3 Rule and Service Changes

Rules, prices, rewards, perks, webstore items, vote rewards, server settings, rates, maps, mods, commands, and services may be updated, changed, removed, or replaced at any time without prior notice.

Continued use of Lusty Looters after changes are made means you accept the updated rules, terms, privacy notices, and service conditions.

9.4 Final Authority

Server management reserves the right to interpret, enforce, modify, or waive rules where needed to protect the cluster, community, economy, performance, safety, or services.

Final decisions regarding access, punishments, bans, refunds, replacements, support outcomes, and enforcement are made by server management, except where applicable law requires otherwise.
